Terms of Use

THIS TERMS OF USE AGREEMENT (the “Agreement”) constitutes a legally binding agreement by and between Nanu Alina PFA (“Provider”) and the client, whether personally or on behalf of an entity (“Client”), with regard to access and use of anovaweb.net (the “Website”) and any other media form, channel, mobile website or related application linked thereto.
Failure to agree and adhere to all of the terms, conditions, and obligations contained herein results in the express prohibition of the Client’s use of the Website, and the Client is ordered to discontinue use immediately. Thereafter, the relationship between Client and Provider shall cease and be of no further force and effect, except that any obligation of Client to pay Provider for services rendered shall remain an ongoing obligation.

In the payment process or when requesting services, the Client declares that they have read and accept these Terms of Use.
These Terms are available at all times in a manner that allows their storage, reuse, and reproduction.

The content of the website https://anovaweb.net and all its versions is the property of Nanu Alina PFA.

Limitation of Liability

The Provider makes every effort to ensure that all information on the Website is accurate and up to date. However, users are advised that all content is provided for informational purposes only. The Provider does not guarantee or assume any responsibility for the accuracy or completeness of the Website’s content. Clients use all published content at their own risk.

Neither Nanu Alina PFA nor any other individual or legal person who participated in the creation or production of this Website shall be held responsible for:

  • temporary interruptions in service,

  • inaccuracies or omissions in content, or

  • any damage or inconvenience resulting from the use of inaccurate or incomplete information.

The Provider is not responsible for any damage, loss, or inconvenience resulting from the existence, use, or inability to use the Website or its information, regardless of prior notice of possible damage.

Clients must ensure the protection of their own equipment (such as antivirus software) before accessing the Website. Clients are solely responsible for maintaining the confidentiality of their login credentials or any communication details shared through the Website.

Intellectual Property Rights

All original source files and design materials created specifically for the Client (“Projects”) are the property of the Client upon full payment.
If any law causes ownership to transfer to the Provider, the Provider irrevocably assigns those rights to the Client.
The Client guarantees that all materials provided to the Provider for use in projects do not infringe any third-party rights.

The Provider reserves the right to display completed works publicly (such as on social media or the Provider’s website) unless an NDA (non-disclosure agreement) has been signed.

Third-Party Fonts

If a project incorporates fonts that require a commercial license, the Provider will inform the Client, who will then be responsible for purchasing the necessary licenses from the rights-holder(s). The Provider will provide details about the required fonts and their sources. Once informed, the Client assumes all responsibility for obtaining proper licensing.

User Representations

By using the Website, the Client represents that they:

  • have the legal capacity to agree to these Terms,

  • are not a minor in their jurisdiction,

  • will not access the Website through automated or unauthorized means,

  • will not use the Website for illegal or prohibited purposes, and

  • will not violate any applicable law or regulation.

Prohibited Activities

Clients are prohibited from:

  • unauthorized use of the Website,

  • scraping or collecting data to create databases,

  • interfering with Website security,

  • misleading or defrauding the Provider or users,

  • attempting to reverse-engineer or decompile the Website,

  • uploading viruses or harmful code,

  • harassing or threatening the Provider or its contractors, or

  • violating any applicable laws.

User Data and Privacy

By using the Website, Clients agree to the Privacy Policy, which governs data collection, processing, and protection.
The Website is hosted in the European Union and operates under GDPR compliance.

Connection Interruptions

The Provider does not guarantee uninterrupted Website access. Technical issues may occur beyond the Provider’s control. The Provider is not liable for damages caused by such interruptions.

Governing Law and Dispute Resolution

This Agreement is governed by the laws of Romania.
The Provider respects Romanian consumer protection laws and strives to resolve disputes amicably.

If a legal resolution is necessary, disputes shall be handled by the competent courts in Sibiu, Romania.

Disclaimer

The Website is provided “as is” and “as available.” The Provider makes no warranties, express or implied, regarding the accuracy, reliability, or availability of the Website or its services.
The Provider is not liable for any direct, indirect, or incidental damages arising from the use or inability to use the Website or its content.

Electronic Communications

By using the Website, the Client agrees to receive electronic communications and acknowledges that electronic agreements and records satisfy all legal requirements for written communication.

Showcasing Design Work

The Provider reserves the right to showcase completed design work in its portfolio, including digital channels, unless otherwise agreed upon through an NDA.

Miscellaneous

These Terms constitute the entire agreement between the Client and Provider.
If any provision is deemed invalid or unenforceable, the remaining provisions shall continue in full force.
Failure by the Provider to enforce any right or term does not constitute a waiver of such rights.
